Summary:
On February 11, 2005 Arizona’s Governor issued Executive Order 2005-05 requiring new state-funded buildings to include renewable energy in their power mix and to meet energy efficiency and green building standards. Executive Order 2008-29 reaffirmed those goals and established a new requirement for state agencies to conduct an analysis of their energy usage by January 15, 2009 and to identify what is required to meet their goals. Executive Order 2008-29 also called on the Department of Administration to immediately initiate energy performance contracts for all state agencies that are short in meeting their energy reduction goals. The Department of Administration must report on its progress on a quarterly basis starting April 1, 2009.  
 
All state-funded buildings constructed after February 11, 2005 are to be designed and constructed to derive at least 10% of their energy from a renewable resource. Renewable resources may include solar, wind, or use of thermal energy from biomass fuels for heating and/or cooling. This goal may also be met through the purchase of renewable energy credits as defined by the Department of Commerce Energy Office. Additionally, all new state-funded buildings must meet at least the "silver" Leadership in Energy & Environmental Design (LEED*) standard.  
 
The Arizona Department of Administration, Arizona Department of Transportation and the Arizona School Facilities Board are required to submit a report to the Governor and to the Department of Administration by August 1, 2005, and annually thereafter, summarizing: (a) actions taken to achieve the renewable and energy efficiency goals of the Order; and (b) the extent to which the goal has been achieved; and (c) if the goal was not achieved, an explanation of why and an assessment of what can be done to achieve the goals. The Executive Order is directed toward Executive Branch agencies, but all other branches of state government are also encouraged to review and comply with the design standards.  
 
Arizona also has some requirements for their buildings contained within their statutes. A.R.S. § 34-451 requires the Department of Administration, the Department of Transportation and the Arizona Board of Regents to reduce their energy use by 15% by July 1, 2011 using July 1, 2001 through June 30, 2002 as the baseline year. The statute also requires all departments to purchase products certified by Energy Star or the federal energy management program (FEMP) in all categories that are available unless the products are shown not to be cost-effective on a life cycle cost basis.
